Your properly completed and delivered order form constitutes your offer to purchase the products or services referenced in your order. Your order shall be deemed to be accepted only if and when Edgepark or its supplier or vendor sends an order acceptance and shipping notice email to your email address. Verification of information may be required prior to Edgepark’s acceptance of an order placed through the Website. Edgepark reserves the right to limit quantities of items purchased by each customer or to refuse to provide any customer with any such items. Resale of products or services purchased in connection with the Services is specifically prohibited. Edgepark reserves the right to refuse to sell products or services to you if it reasonably appears to us that you intend to resell such products or services.

Price (including the validity of any discount), quantity, availability of any product or service, and shipping methods and shipping rates, and any other information, descriptions or images on the Service regarding any products or services, are subject to change without notice.

You may discontinue your use of the Website at any time. Your use of the Website may be discontinued by Edgepark at any time for any reason or no reason. If your use of the Website has been discontinued, reasonable efforts will be made to notify you that your use has been discontinued.

Edgepark is not providing medical services through the Website. The content of the Website and the Services do not constitute professional medical advice, diagnosis, treatment, or recommendations of any kind. By accepting these Terms, you acknowledge and agree that you are solely responsible for consulting with an appropriate healthcare provider before making any medication adjustments or pursuing any medical actions.

The words “Edgepark Medical Supplies” and its associated corporate logos are the trademarks and service marks of RGH Enterprises, LLC. You are prohibited from using any trademark, service mark or logo displayed on the Website without the express permission of Edgepark.

In no circumstance shall Edgepark be liable to you for any act or failure to act by any third party. If you are dissatisfied with the Website or these Terms, your sole and exclusive remedy is to terminate your access to the Website. If any portion of the foregoing limitation is found to be void or unenforceable, the liability of Edgepark for any damages resulting from or relating to the use of the Website shall be limited to $10.00.

12. Governing Law; Venue

These Terms shall be governed by and construed under the laws of the State of Ohio, without reference to the conflict of laws or principles thereof. The parties hereby irrevocably agree that all actions or proceedings in any way, manner or respect arising out of or from, or related to these Terms or the services referenced herein shall be litigated only in courts having situs within Summit County, Ohio. You may not assign any of your rights or obligations under these Terms to any third party without the express, prior written consent of Edgepark. Any attempted assignment in violation hereof shall be null and void and of no effect whatsoever. In connection therewith, the parties hereby consent and submit to the jurisdiction of any local, state or federal court located within said county and state and hereby waive any right the parties may have to transfer or change the venue of any such litigation.

14. Miscellaneous

If any provision of these Terms is found to be invalid or unenforceable by a court of competent jurisdiction, such provision shall be reformed only to the extent necessary to make it enforceable and the other terms of this agreement shall remain in full force and effect. You cannot transfer your rights or obligations under the Terms to anyone without the prior written consent of Edgepark. The failure by Edgepark to enforce any provision of these Terms does not waive Edgepark’s right to enforce the same provision in the future.
